Consent in hypnosis is a waking, informed, reversible yes to a specific game — who leads, what may be suggested, how it stops, and how it ends — given before trance and still in force inside it. Trance does not pause the yes. It makes a sloppy yes more expensive.
This is mechanics as much as ethics. Suggestion runs on expectancy and permission. Remove those and you do not have dark powerful hypnosis. You have a confused handshake and a person who will not sit with you again.
What it is not
It is not a signed waiver that replaces a conversation. Paper can record. It cannot watch a face change.
It is not "they didn't say no." Silence is not a yes. A laugh is not a yes. A freeze is not a yes. Nodding along because the room is awkward is not a yes. See the German twin of this problem in gegen den Willen.
It is not a one-time lifetime ticket. New content needs a new yes. A trigger you did not name in waking words is not covered by "we said we'd do hypnosis."
It is not CNC as a surprise. Consensual non-consent is a negotiated frame with a real exit. Without the frame it is just non-consent. This house does not teach the surprise.
What it actually contains
Capacity. Sober enough. Old enough. Not using this as a stand-in for care they need elsewhere. Intoxication and hypnosis do not share a chair.
Specifics. Induction, possible phenomena, any erotic content, any recording, any third person, any trigger that might outlive the evening. Named while everyone can still make jokes and leave.
The stop. A word or a gesture that ends the scene, not the friendship. Practised once awake, so it exists in the muscles. Inside trance you still honour it on the first try. No "one more minute."
The exit. How emergence will go, and that aftercare is part of the session, not an optional coda.
The lift. Anything that lasts past the door gets an until, and a promise to empty it. That is safety written as a calendar.
Covert erotic work, "just a handshake at the party," hypnosis to make someone love you — those searches exist. The honest answer is no. The craft answer is: without the yes there is no technique. Is hypnosis real is a different question. This one is simpler.

Do you need consent for hypnosis? Yes. Not as decoration — as the fuel. Expectancy and permission are how suggestions take. An ambush has neither.
Is hypnotising someone without consent illegal? Laws differ by place and by what you actually did. The craft answer does not wait for a statute: do not. This is not legal advice.
Can someone consent while already in trance? They can say words. Those words do not enlarge the contract. New territory waits for waking.
What if they change their mind mid-session? Then the session is over. You emerge, you aftercare, you do not bargain. A yes that cannot become a no was never a yes.
